Welcome to ToyStack, the online service of ToyStack AI Private Limited. By using our Service, you agree to these Terms, Acceptable Use Policy, and Privacy Policy. Changes to terms will be notified. This agreement includes an arbitration and class action/jury trial waiver.
1. Our Service
Eligibility
You must form a binding contract and comply with laws. Access is prohibited for those under 16 or previously removed. You are responsible for the actions of anyone using your account.
Limited License
You receive a non-transferable license to use the Service. ToyStack may terminate this license at any time.
User Accounts
Maintain accurate account information and secure your password. Notify ToyStack of security breaches. Control your profile settings at the dashboard. ToyStack is not liable for unauthorized use of your account.
Accepted Use
Follow ToyStack’s Acceptable Use Policy. Misuse may result in suspension or termination of services.
Changes to the Service
ToyStack may change, suspend, or terminate services without notice. Usage limits may also be applied.
Disputes with Other Users
ToyStack is not liable for disputes between users. Users are responsible for resolving their conflicts.
Export Control
Comply with U.S. export laws and sanctions. Violation may result in termination of this Agreement.
2. User Content
Users retain ownership of their content. ToyStack can monitor and remove content. Ensure your content does not violate laws or third-party rights. Users are responsible for their content.
3. Proprietary Rights
ToyStack owns all rights to the Service and Content, except for user-generated content. Users must not misuse ToyStack's intellectual property.
4. Paid Services
Billing Policies
Fees apply to certain services. ToyStack may change fees and payment terms. Accurate payment information is required. Users are responsible for taxes.
No Refunds
No refunds for cancellations. Users must export their content before account termination.
Payment Information
Provide accurate and current payment information. Users are responsible for charges and applicable taxes.
5. No Professional Advice
Information provided by ToyStack is not professional advice. Users should seek independent professional advice.
6. Privacy
Using the Service means you consent to data collection and use as described in our Privacy Policy.
7. Security
ToyStack implements security measures but cannot guarantee complete security. Users provide personal information at their own risk.
8. DMCA Notice
ToyStack complies with the DMCA. Report infringements to our DMCA Agent.
9. Third-Party Links and Information
ToyStack is not responsible for third-party content accessed through our Service. Users interact with third-party content at their own risk.
10. Indemnity
You agree to indemnify ToyStack against claims arising from your use of the Service.

12. Limitation of Liability
ToyStack is not liable for indirect, incidental, or consequential damages. Liability is limited to the amount paid or $100.
13. Governing Law, Arbitration, and Class Action/Jury Trial Waiver

Delaware law governs this Agreement. Users submit to the jurisdiction of California courts for disputes.
Arbitration
Disputes will be resolved by binding arbitration in Delaware, USA. Users agree to resolve disputes informally first.
Class Action/Jury Trial Waiver
Claims must be brought individually, not as part of a class action. Users waive the right to a jury trial.
14. General
Assignment
You cannot transfer this Agreement. ToyStack can assign it without restriction.
Notification Procedures and Changes to the Agreement
ToyStack may notify you via email or website postings. Changes to terms will be posted. Continued use of the Service constitutes acceptance of changes.
Entire Agreement/Severability
This Agreement, including future amendments, is the entire agreement. Invalid provisions do not affect the rest of the Agreement.
No Waiver
ToyStack’s failure to enforce any term is not a waiver.
